The Next Stories reserves the right, at its sole discretion and without notice, to : 9.2.1 Types of Sanctions · Temporarily suspend access to the Account · Restrict certain Account functionalities · Temporarily ban the User · Permanently ban the User and delete their Account 9.2.2 Grounds for Sanctions These sanctions may be applied notably in case of: · Violation of these Terms · Non-compliance with third-party AI service terms of use · Fraudulent or harmful use of the Services · Non-payment of amounts due · Provision of inaccurate or misleading information · Attempt to circumvent technical restrictions · Harmful behavior toward other Users · Use of Services for illegal purposes · Any other behavior that The Next Stories deems inappropriate or harmful 9.2.3 Application to Paid Accounts These sanctions apply to all Users, including those having: · Subscribed to a paid plan · Purchased additional credits · Made any other type of payment In case of suspension or termination for violation of the Terms: · No refund will be made for the remaining subscription period · Unused credits will be forfeited · The User cannot claim any compensation 9.2.4 Procedure and Notifications · The Next Stories will endeavor, when possible, to warn the User before applying sanctions · In case of serious violation, sanctions may be applied immediately and without notice · The User will be informed by email of applied sanctions and their reasons · In certain cases, the User may appeal the decision by contacting support 9.2.5 Consequences of Termination In case of Account termination: · Access to Services will be immediately interrupted · Data associated with the Account may be deleted · The User must cease all use of the Services · Generated content may be retained in accordance with our legal obligations
10. Modifications to Terms
We reserve the right to modify these Terms at any time. Modifications take effect 30 days after notification to Users. Continued use of the Services constitutes acceptance of the new Terms.
11. General Provisions
11.1 Applicable Law
These Terms are governed by French law.
11.2 Competent Jurisdiction
Any dispute relating to these Terms falls under the exclusive jurisdiction of the courts of Nantes, subject to contrary mandatory legal provisions.
11.3 Severability
If a provision of these Terms is deemed invalid, the other provisions retain their full effect.

"Content": means any element (text, image, video, etc.) created, imported or shared via the Services. "Input Data": means content provided by the User to use the Services. "Output Data": means content generated by the Services from Input Data. "AI": means Artificial Intelligence.
2. Access to Services
2.1 Access Conditions
Access to the Services is reserved for Users aged at least 18 years or having legal capacity to enter into a contract. Use of the Services by a minor is prohibited.
2.2 Account Creation
Using the Services requires creating a User Account. You undertake to: · Provide accurate and complete information · Keep this information up to date · Protect the confidentiality of your login credentials · Inform us immediately of any unauthorized use of your Account
3. Subscriptions and Payments
3.1 Offers and Pricing
The pricing and terms of our various subscription offers are detailed on our platform. We reserve the right to modify these prices at any time, subject to informing the Users concerned.
3.2 Billing
Payments are made according to the frequency chosen during subscription. Invoices are issued electronically and available in your customer area.
3.3 Right of Withdrawal
In accordance with applicable legislation, you have a withdrawal period of 14 days from subscription to a paid plan.
4. Intellectual Property and Use of AI
4.1 The Next Stories' Rights
The Next Stories retains ownership of all intellectual property rights relating to the Services, including software, designs, trademarks, logos and content created by The Next Stories.
4.2 Usage License
We grant you a limited, non-exclusive, non-transferable and revocable license to use our Services in accordance with these Terms.
4.3 User Content
You retain your rights to the Input Data you provide. By submitting them, you grant us a worldwide, non-exclusive and free license to use, modify and exploit them as part of our Services.
4.4 AI and Third-Party Services
4.4.1 Use of Third-Party Generative AI Services The Next Stories provides its Users with generative AI services supplied by third parties via their APIs. It is important to note that: · The Next Stories does not own the generative AI models used on the platform · These services are provided by third-party companies (such as OpenAI, Anthropic, Google, etc.) via their APIs · Each AI model is subject to its own terms of use defined by its provider 4.4.2 Third-Party Service Obligations By using our Services, you acknowledge and accept that: · You must comply with the specific terms of use for the AI model you select · These terms are accessible before selecting each model on our platform · Different models may have different restrictions or obligations · The Next Stories cannot be held responsible for limitations or restrictions imposed by third-party providers 4.4.3 Model Selection and Use When using our platform: · You will be clearly informed of the AI model used for each content generation · The specific terms of use for the selected model will be presented to you · You must confirm that you have read and accept these terms before use · Certain models may have particular restrictions on commercial use of generated content 4.4.4 Responsibilities and Limitations The Next Stories: · Acts as a technical intermediary for access to these AI services · Cannot guarantee continuous availability of different AI models · Reserves the right to modify the list of available models · Is not responsible for decisions made by third-party providers regarding their services 4.4.5 AI Act Compliance Commitment We commit to: Clearly and transparently inform Users when they interact with AI systems Not use AI to: · Manipulate User behavior · Exploit vulnerabilities related to age or other circumstances · Evaluate or classify individuals based on their social behavior · Infer emotions for commercial purposes Ensure transparency regarding: · The capabilities and limitations of our AI systems · The data used for training our models · Automated decision-making processes
4.5 AI-Related Guarantees

In accordance with the AI Act, we classify our AI systems according to their risk level and apply appropriate protective measures. We commit not to use AI systems presenting unacceptable risks.
8.2 Transparency
We explicitly inform Users: · When they interact with an AI system · About the limits and capabilities of the AI systems used · How automated decisions are made · Of their right to human oversight in appropriate cases
8.3 Rights Protection
We commit to: · Protect Users' fundamental rights · Prevent algorithmic discrimination · Ensure fairness and impartiality of systems · Allow contestation of important automated decisions
8.4 Incidents and Security

9. Termination
9.1 Termination by User
You may terminate your subscription at any time from your customer area. Termination will take effect at the end of the current period.
